Robert Alexy has argued that the democratic objection to judicial review of legislation can be successfully addressed by assuming that judges exercise a special form of argumentative representation. In this article we argue that Alexy does not explain (as he should) under what circumstances judicial review tends to produce better decisions than parliamentary procedure, nor does he explain how judicial review can have a greater intrinsic value than parliamentary procedure. Subsequently, we argue that the intrinsic value of argumentative representation depends (...) on the promotion of citizen deliberation, whereas its instrumental value depends on judges being committed to the rights of discrete and insular minorities in the face of hostile majorities. This dissertation proposes the central elements of a Social Enactive Theory of Perception. According to SEP, perception consists in sensory-based practices of interaction with objects, events, and states of affairs that are socially constituted. I oppose the representational view that perception is an indirect contact with the world, consists of the passive receiving and processing of sensory input, is in need of constant assessment of accuracy, and is a matter of individuals alone. I share the basic enactivist insight that perception (...) is a type of activity, but I depart from standard enactivism on the grounds of its individualistic bias and its limited conception of activity. Instead of motor actions, I formulate the concept of perceptual practices as the appropriate framework to understand perception. Perception is woven into socially informed, contextual, sensory-based everyday activities, such as food, dance, and dress, and even seemingly independent, basic perceptual activities and concepts are constituted by such practices. Perceptual individual interactions instantiate social perceptual practices but are not just repetitions of a script. We perceive objects in virtue of perspectives or appearances, not in spite of them, and on this basis I offer SEPâs take on experience, properties, and contents. I conceive perceptual experience as finely grained interactions between subjects and objects, both of which are spatially, temporally, and pragmatically situated. Objects and their sensory properties are perceived dynamically and always in multiple appearances. Perceptual content offers a pragmatic specification of the perceptual objects in the specific ways they appear to subjects. For SEP, perception is normatively structured. SEPâs perceptual normativity is not a worry about a supposed constant threat that our perceptions be nonveridical, but about the placement of perceptual things in a system of possibilities and expectations, cast in terms of degrees of fulfillment of expectations and in a horizon of pragmatic significance, both of which are functions of the socially constituted interactions between a perceiver and a rich theory of appearances. Macrocephaly is present in about 2–5% of the general population. It can be found as an isolated benign trait or as part of a syndromic condition. Brain overgrowth has been associated with neurodevelopmental disorders such as autism during the first year of life, however, evidence remains inconclusive. Furthermore, most of the studies have involved pathological or high-risk populations, but little is known about the effects of brain overgrowth on neurodevelopment in otherwise neurotypical infants. We investigated the impact of brain overgrowth (...) on basic perceptual learning processes during the first year of life. We recorded high density electroencephalograms in 116 full-term healthy infants aged between 3 and 11 months, 35 macrocephalic and 81 normocephalic classified according to the WHO head circumference norms. We used an adapted oddball paradigm, time-frequency analyses, and auditory event-related brain potentials to investigate differences between groups. We show that brain overgrowth has a significant impact on repetition effects and change detection response in the 10–20 Hz frequency band, and in N450 latency, suggesting that these correlates of sensorial learning processes are sensitive to brain overgrowth during the first year of life. RESUMEN Se hace un breve recuento sobre la mujer en la filosofia y la crítica a la visión patriarcal predominante en la filosofía, en particular se resalta a la filósofa María Zambrano como filósofa del siglo XX y su pensamiento político, como un giro en la mirada de lo que hasta el momento se ha destacado en su obra. Se desarrolla el contenido a partir de una introducción y cuatro apartados, en los que se aborda una reflexión sobre el género (...) como constructo cultural, cargado de sentidos de lo masculino y femenino, y se plantea asimismo la relación con el lugar de la mujer en la filosofía. Luego se centra la exposición en María Zambrano y su filosofía, en la búsqueda de la comprensión de su pensamiento, sosteniendo la importancia que tiene el reconocimiento de su vida y obra a partir de su contexto histórico. En las conclusiones se muestran los matices en la filosofía zambraniana, la multiplicidad de lecturas e interpretaciones que pueden hacerse de la misma. ABSTRACT This paper presents a brief historical account of woman in philosophy and the critique to the patriarchal vision predominant in philosophy. Maria Zambrano is highlighted as a twentieth-century philosopher as well as her political thought, marking a change of direction in the look at what so far has been highlighted in her work. The content, an introduction and four sections, addresses gender as a cultural construct plenty of masculine and feminine meanings and its relationship to women's role in philosophy. Then, the paper focuses on Maria Zambrano and her philosophy, looking for understanding her thought, keeping in mind the importance of recognizing her life and work from its historical context. In the conclusions the nuances in the Zambranian philosophy and the multiplicity of readings and interpretations that can be made of it are shown. (shrink)

Based on interviews with 40 first-time mothers, the authors develop an argument that supplements the critique of medicalized childbirth by focusing on the social context in which women give birth. Particularly important about that context is women's privatized responsibility for babies' well-being, and a dearth of social supports for mothering, including the sharing of that responsibility by fathers. Contextualizing childbirth in this way makes clearer not only why many women are favorable toward medical intervention but also the decisions women make (...) during hospital births. The women we interviewed displayed widely ranging reactions to giving birth in the hospital. Describing their experiences, these women often emphasized pain and anxiety. Both conditions appear to have been relieved as effectively by social support as by medical assistance. Furthermore, women who had generally supportive partners were less likely to receive medical intervention during the birth and less likely to suffer postpartum depression. (shrink)

This paper tries to clarify the coincidence between some of the main features of the characterization of perception in the phenomenology of Merleau-Ponty (Phenomenology of Perception) and the picture technique of Cézanne. Although placed in different work areas, indeed, the reflection about the perceptive act and the process of pictorical creation, there is an inspirational shared basis: Merleau-Ponty’s notion of “original experience” goes parallel to Cézanne’s understanding of the painting as a the original appearing of the things so as they (...) should appear to a glaze that goes beyond the objectivating categories of every daily, normal perception. In this article the author presents Husserl’s analysis of the problem of time-consciousness in the C-Manuscripts (1929-1934). He tries to discuss the reasons why Husserl introduces the concept of “living present” and the necessity of distinguishing the originary temporalizing flux of absolute consciousness and the immanent time where acts are placed when they become object of an act of reflection. Another important issue is the introduction of a Ur-Ich, which works anonymously and temporalizes itself. It will be also studied why (...) Husserl considers at the end that temporalization is an non-intentional passive process that works at the deepest level of consciousness. (shrink)

Collaborative remembering, in which two or more individuals cooperate to remember together, is an ordinary occurrence. Ordinary though it may be, it challenges traditional understandings of remembering as a cognitive process unfolding within a single subject, as well as traditional understandings of memory knowledge as a justified memory belief held within the mind of a single subject. Collaborative memory has come to be a major area of research in psychology, but it has so far not been investigated in epistemology. In (...) this chapter, we attempt an initial exploration of the epistemological implications of collaborative memory research, taking as our starting point the “extended knowledge” debate which has resulted from the recent encounter between extracranialist theories of cognition and externalist theories of knowledge (Carter et al., 2014; Carter et al., forthcoming). Various forms of socially and technologically augmented memory have played important roles in the extended knowledge debate, but the debate has so far not taken collaborative memory, in particular, into account. We will argue that collaborative memory supports a novel externalist theory of knowledge: distributed reliabilism. Distributed reliabilism departs in two important respects from both traditional reliabilism (Goldman, 2012) and updated theories such as extended (Goldberg, 2010) and social reliabilism (Goldman, 2014). First, it acknowledges that belief-forming processes may extend extracranially to include processing performed both by other subjects and by technological artifacts. Second, it acknowledges that distributed sociotechnical systems themselves may be knowing subjects. Overall, then, the main aim of the chapter is to draw out the philosophical implications of psychological research on collaborative memory. But our argument will also suggest that it may be useful to broaden the standard conception of collaborative memory to include not only the sorts of direct interactions among subjects that have been the focus of psychological research so far but also a range of more indirect, technology-supported and -mediated interactions, and it thus has implications for psychology as well. Among the phenomena that make up the mind, cognitive psychologists and philosophers have postulated a puzzling one that they have called ?epistemic feelings.? This paper aims to (1) characterize these experiences according to their intentional content and phenomenal character, and (2) describe the nature of these mental states as nonconceptual in the cases of animals and infants, and as conceptual mental states in the case of adult human beings. Finally, (3) the paper will contrast three accounts of the causes and (...) mechanisms of epistemic feelings: the doxastic account; the mental scanner account; and the heuristic mechanism account. Faced with the absurdity of continued climate inaction, more people are becoming morally outraged about the projections of human suffering and loss due to global warming impacts. This article draws from the work of Albert Camus to examine human responses to absurdity through rebellion and how this can be applied to understand the notion of climate rebellion. Focusing on Camus’ works The Rebel and The Plague, as well as his speech “The Human Crisis”, I examine the conditions of climate injustice (...) that present the grounds for climate rebellion, what becoming a climate rebel might mean, the importance of solidarity in climate rebellion, and lastly how Camus’ value of limitation might inform ethical responses to minimize climate-related harm. Recent debates on mental extension and distributed cognition have taught us that environmental resources play an important and often indispensable role in supporting cognitive capacities. In order to clarify how interactions between the mind –particularly memory– and the world take place, this paper presents the “selection problem” and the “endorsement problem” as structural problems arising from such interactions in cases of mental scaffolding. On the one hand, the selection problem arises each time an agent is confronted with a cognitive problem, (...) since she has to choose whether to solve it internally or externally. How does she choose? On the other hand, when confronted with the internally or externally retrieved solution to a cognitive task, the subject has to decide whether to endorse the information. How does the subject decide whether to endorse it or not? The last section proposes a solution to each problem in terms of metamemory and metacognitive feelings. Metamemory evaluates memory each time the subject is confronted with a memory task and elicits either a positive or negative metacognitive feeling that guides the decision. (shrink)

This paper examines the difficulties of dealing with child labour in the supply chain. It begins by identifying a number of the factors which make global supply chains so difficult to manage. It goes on to outline a framework of different approaches that can be taken to managing the supply chain with relation to child labour, moving from national and international regulation, through to the role of NGOs and the companies themselves. Focusing on an ‘engagement’ strategy for dealing with child (...) labour, the paper traces a case study of Adidas‐Salomon and its attempts to implement their ‘standards of engagement’ in this area with relation to one of their supplier factories in Vietnam. The research draws on the direct involvement of one of the authors who visited the site and was able to interview staff and observe the operation in practice. Her findings are supported by wider work on the implementation of corporate approaches to human rights at a range of companies interviewed by another of the authors. The paper aims to highlight the issues needing to be addressed for companies considering the ‘involvement’ approach to child labour. It also aims to develop theory on our understanding of different approaches to corporate rights. (shrink)

Two main theories about metacognition are reviewed, each of which claims to provide a better explanation of this phenomenon, while discrediting the other theory as inappropriate. The paper claims that in order to do justice to the complex phenomenon of metacognition, we must distinguish two levels of this capacity—each having a different structure, a different content and a different function within the cognitive architecture. It will be shown that each of the reviewed theories has been trying to explain only one (...) of the two levels and that, consequently, the conflict between them can be dissolved. The paper characterizes the high-level as a rationalizing level where the subject uses concepts and theories to interpret her own behavior and the low-level as a controlling level where the subject exploits epistemic feelings to adjust her cognitive activities. El objetivo de este artículo es aclarar la crítica que el psicoanalista Jacques Lacan dirige al concepto marxista de plus-valía tal y como es formulado en el Capital de Marx. Tras el concepto de una plus-valía contable Lacan quiere desvelar la necesidad de atender a la noción más fundamental de un plus-de-gozar [plus-de-jouir] incontable. Atenderemos para ello a diferentes pasajes de sus seminarios XVI (1968-69), XVII (1969-70) y de su texto Radiofonía (1970).

Los textos acerca del tiempo de Edmund Husserl (1859-1938) se organizan en torno a tres núcleos temáticos. En una primero época, en las Lecciones de fenomenología de la conciencia interna del tiempo (1904-1905), el hilo conductor es la pregunta acerca de cómo la percepción de un objeto que dura (tiempo objetivo) es constituida por una conciencia que vive en el tiempo inmanete y cómo esta es el resultado de un plano anterior -conciencia interna-. En un segundo momento, en los manuscritos (...) de Bernau (1917-1918) y en los textos sobre el carácter pasivo de los procesos de la conciencia (1921), Husserl profundiza en la relación entre conciencia, reflexión y temporalidad, y destaca la pasividad con la que se llevan a cabo las operaciones de constitución de la conciencia. Por último, en los manuscritos C (1929-1934) introducirá la noción de presente viviente como centro desde el que pensar toda la temporalidad. A la par que una investigación sobre el carácter eternamente enigmático del tiempo, los análisis de Jusserl revelan el ser fundamentalmente temporal de nuestra conciencia, en un ejercicio riguroso de pensamiento que lleva a la fenomenología hasta los límites de su potencial descriptivo. La investigación sobre leyes de la naturaleza constituye una de las aventuras del intelecto humano en su esfuerzo primigenio por entender la realidad y nuestro lugar en ella. En la primera parte del libro expondremos la aproximación biográfica que motiva nuestra investigación (capítulo 1). La segunda parte examina los orígenes históricos del imaginario de leyes de la naturaleza que se remontan a la filosofía natural de la época de Descartes y Newton (capítulos 2 y 3). La tercera parte sistematiza el (...) debate estándar en filosofía de las leyes de la naturaleza, que se ha consagrado en las concepciones humeanas y anti-humeanas, en donde las primeras sostienen que las leyes son meros enunciados de regularidades (capítulo 4), mientras que las segundas afirman que ellas corresponden a alguna clase especial de necesidades naturales (capítulos 5 y 6). En la cuarta parte propondremos nuevas perspectivas sobre las leyes de la naturaleza que escapan al debate estándar. Examinaremos el problema de Wigner acerca de la efectividad de las matemáticas en la formulación de leyes físicas (capítulo 7), elaborando la concepción inferencial de las leyes que ofrece una respuesta al problema wigneriano (capítulo 8). Asimismo, indagaremos el carácter modal de las leyes de la naturaleza (capítulo 9) y el supuesto metafísico que afirma que la realidad tiene una estructura, que ha sido asociada a las leyes (capítulo 10). Finalmente, en la quinta parte del libro cerraremos nuestra investigación elaborando el eliminativismo nómico, que nos insta a abandonar el imaginario de leyes de la naturaleza tanto en ciencias como en nuestra interpretación filosófica de las mismas (capítulos 11 y 12). The intensification of cross-sector collaboration phenomena has occurred in multiple fields of action. Organizations in the private, public, and social sectors are working together to tackle society’s most wicked problems. Some success has resulted in a generalized belief that cross-sector collaborations represent the new paradigm to manage complex problems. Yet, important knowledge gaps remain about how cross-sector alliances generate value for society, particularly to its beneficiaries. This paper answers the question: How cross-sector collaborations lead to systemic change? It uses a (...) qualitative embedded case study design. I use two general cases of alliance-based interventions in the developing country Colombia. Embedded cases within each general case identify evidence of collective action capacity of the beneficiaries. Findings identify and explain alliances’ contributions to beneficiaries’ capacity building: brokering trust and creating spaces where beneficiaries develop an emergent collective action capacity. Alliances also enable beneficiaries to enact that capacity by building bridges, circulating capitals, and buffering relationships to protect people’s initiatives. Alliances and empowered collectives of beneficiaries produce systemic change using five mechanisms: brokering trust, creating spaces, building bridges, circulating capitals, and buffering relationships. Beneficiaries increased capacity for collective action is an outcome that becomes an alliance input, leading overtime to further benefits involving systemic change. (shrink)

New Materialisms brings into focus and explains the significance of the innovative materialist critiques that are emerging across the social sciences and humanities. By gathering essays that exemplify the new thinking about matter and processes of materialization, this important collection shows how scholars are reworking older materialist traditions, contemporary theoretical debates, and advances in scientific knowledge to address pressing ethical and political challenges. In the introduction, Diana Coole and Samantha Frost highlight common themes among the distinctive critical projects that (...) comprise the new materialisms. The continuities they discern include a posthumanist conception of matter as lively or exhibiting agency, and a reengagement with both the material realities of everyday life and broader geopolitical and socioeconomic structures. Coole and Frost argue that contemporary economic, environmental, geopolitical, and technological developments demand new accounts of nature, agency, and social and political relationships; modes of inquiry that privilege consciousness and subjectivity are not adequate to the task. New materialist philosophies are needed to do justice to the complexities of twenty-first-century biopolitics and political economy, because they raise fundamental questions about the place of embodied humans in a material world and the ways that we produce, reproduce, and consume our material environment. En especial en las escuelas marxista, neoclásica y keynesiana. El influjo de su pensamiento puede evidenciarse en el abordaje metodológico, antropológico e institucional. Se ofrece una Mirada sobre la sociedad civil (comercial), el Mercado y el Estado al mismo tiempo. Hobbes ha sido la inspiración de un concepto de Estado monolítico en lo político, en este sentido, la mirada (...) de la economía bajo el concepto de un gran planificador centralizado, tiene importantes antecedentes en este autor. El ejercicio del control social del individuo como propuesta institucional, en varias escuelas de la economía comparten con Hobbes, varios antecedentes que merecen ser analizados. (shrink)

The cognitive phenomenology thesis claims that “there is something it is like” to have cognitive states such as believ- ing, desiring, hoping, attending, and so on. In support of this idea, Goldman claimed that the tip-of-the-tongue phe- nomenon can be considered as a clear-cut instance of non- sensory cognitive phenomenology. This paper reviews Goldman's proposal and assesses whether the tip-of-the- tongue and other metacognitive feelings actually constitute an instance of cognitive phenomenology. The paper will show that psychological data cast doubt (...) on the idea that the tip-of-the-tongue and other metacognitive feelings are clear-cut instances of cognitive phenomenology. (shrink)

Proponents of enactivism should be interested in exploring what notion of action best captures the type of action-perception link that the view proposes, such that it covers all the aspects in which our doings constitute and are constituted by our perceiving. This article proposes and defends the thesis that the notion of sensorimotor dependencies is insufficient to account for the reality of human perception, and that the central enactive notion should be that of perceptual practices. Sensorimotor enactivism is insufficient because (...) it has no traction on socially dependent perceptions, which are essential to the role and significance of perception in our lives. Since the social dimension is a central desideratum in a theory of human perception, enactivism needs a notion that accounts for such an aspect. This article sketches the main features of the Wittgenstein-inspired notion of perceptual practices as the central notion to understand perception. Perception, I claim, is properly understood as woven into a type of social practices that includes food, dance, dress, music, etc. More specifically, perceptual practices are the enactment of culturally structured, normatively rich techniques of commerce of meaningful multi- and inter-modal perceptible material. I argue that perceptual practices explain three central features of socially dependent perception: attentional focus, aspects’ saliency, and modal-specific harmony-like relations. (shrink)

Although non-being makes the concept of sense doubtful, it is presupposed before any kind of question regarding being and it is constituted in the background which belongs to the transcendental conditions which make knowledge possible.
